APPEARANCES. Appearances for hearings in Department 33 may be made in person or by Zoom (Video or audio) for hearings on Monday, Tuesday, and Wednesday.  A remote appearance is one of our court’s many efforts to allow for flexibility in appearances and provide greater access to justice for all parties seeking relief in Department 33. Appearances for trial shall be in person unless specifically authorized by Judge Lund in advance of the hearing and, if approved by Judge Lund, only if appropriate arrangements have been made regarding admission of evidence and handling of exhibits. Appearances for Mandatory Settlement Conferences (MSCs) shall be in person only. Remember to dress as if you are appearing in person in court during all remote appearances.

VOLUNTEER SETTLEMENT OFFICER LIST.  The court encourages attorneys with experience in family law matters to serve as volunteer settlement officers to assist the court in resolving attorney vs pro per cases on its MSC calendar. Please contact the judicial secretary to Judge Lund, Monika Akuna, at 805-289-8772 if you are willing to serve as a Volunteer Settlement Officer every so often to help us resolve as many cases as we can without trial so that the cases that truly do need a trial receive a trial date in a timely manner.

TIPS FOR HANDLING YOUR CASE WITH JUDGE LUND:

Strong Emphasis on Settlement of Issues at Every Stage of a Case. Judge Lund strongly suggests you take every opportunity to set up and participate in mediation or settlement of any kind as early as practicable in your case. All family law courtrooms are very busy, and the reality is that unless well over 90% of cases settle, you will experience great delays in getting your matter brought to trial. Judge Lund firmly believes that justice delayed is justice denied, and engages in proactive and robust case management at every stage of every case to ensure it is brought to a resolution in a timely manner. To that end, Judge Lund will often conference with attorneys at RFO hearings early in a case to attempt to resolve disputed matters early. Judge Lund is open to help you resolve any issue as it arises with both parties present, including by telephone, if appropriate. Contact the judicial secretary to arrange such a conference.

Preparation for MSCs. Be sure your PDDs are filed prior to your MSC. Be prepared to address what issues have been resolved (with proof via a stipulation or order) and what issues remain outstanding. Be prepared to have meaningful settlement negotiations concerning the outstanding issues at the MSC. Judge Lund generally does not set trials until all discovery is complete, so be prepared to discuss status of outstanding discovery. It is a good idea to treat the MSC as a trial setting conference for purposes of discovery cutoffs, so what when you come to your MSC you have all of the information necessary to present your case. This also will help with meaningful and effective settlement discussions and negotiations.

Continuing Prior Policies. Judge Lund previously served as a Family Law Judge and Child Support Commissioner for 7.5 years and for those familiar with how he handles those cases, he will largely continue to adhere to those previous policies.
